1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of designlab.tools, operated by designlab.tools ("we", "us", or "our"), including the website at https://designlab.tools and the application at https://fmea.designlab.tools.

By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Description of Service

designlab.tools provides a web-based platform for safety engineering analysis, including Failure Mode and Effects Analysis (FMEA), designed for engineering teams.

We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time, with or without notice.

3. Account Registration

To use designlab.tools, you must create an account using a valid Google or Microsoft account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that your use of the service complies with applicable laws

You must be at least 18 years old to use this service. By using the service, you represent that you meet this requirement.

4. Acceptable Use

You agree not to use designlab.tools to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Upload or transmit malicious code, viruses, or harmful content
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Engage in any activity that disrupts or interferes with the service
  • Use the service to store or process sensitive personal data beyond what is necessary for the stated purpose

We reserve the right to suspend or terminate accounts that violate these terms.

5. Your Content

You retain ownership of all content you create using designlab.tools (your FMEA analyses, projects, and data).

By using the service, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the service to you.

You are solely responsible for ensuring that your content does not violate any law or third-party rights.

We do not claim any ownership over your content and will not use it for any purpose other than providing the service.

6. Intellectual Property

The designlab.tools platform, including its design, software, trademarks, and content (excluding user-generated content), is owned by designlab.tools and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the service for your internal business purposes.

You may not copy, modify, distribute, sell, or lease any part of the service or its underlying software.

7. Pricing and Payment

designlab.tools currently offers a free tier. If paid plans are introduced, pricing and payment terms will be communicated in advance and will form part of these Terms.

We reserve the right to change pricing with at least 30 days' notice to existing users.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied.

We do not warrant that the service will be uninterrupted, error-free, or completely secure.

designlab.tools is a productivity tool. All engineering analyses, safety assessments, and technical decisions made using the service remain your sole responsibility. The service does not replace professional engineering judgement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, designlab.tools shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

Our total liability to you for any claims arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify and hold harmless designlab.tools from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the service in violation of these Terms
  • Your violation of any applicable law
  • Your infringement of any third-party rights
  • Content you submit or create using the service

11. Termination

You may terminate your account at any time by contacting us or using the account deletion feature.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to use the service ceases immediately. We will delete your data as described in our Privacy Policy.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Portugal, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Portugal.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, by email or by a prominent notice on our website.

Continued use of the service after changes take effect constitutes your acceptance of the updated Terms.
